1. Interpretation and Definitions

1.1 Interpretation

The words with their initial letter capitalized have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in singular or plural.

1.2 Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means the ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
  • Country refers to: Morocco.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Devosoft, the operator of devosoft.ma.
  • Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.
  • Service refers to the Website, devosoft.ma, including all its features and functionalities, which provide access to training courses (both free and paid) and digital resources available for purchase via a points system.
  • Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-Party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
  • Website refers to Devosoft, accessible from https://devosoft.ma.
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Acknowledgment

These Terms and Conditions govern the use of this Service and constitute the agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, then You may not access the Service.

Your use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy, which describes our policies and procedures on the collection, use, and disclosure of Your personal information.

3. Training, Resources, and Points System

Devosoft.ma is an online platform offering training courses and digital resources:

  • Training Courses: Our platform provides both free and paid training courses in various subjects. Access to paid courses may require registration and payment through the platform.
  • Digital Resources: In addition to training content, we offer digital resources for sale. These include, but are not limited to, code templates (HTML, CSS, JavaScript, React, VueJS, etc.) and design files (Figma, PSD, etc.).
  • Points System:
    • Users purchase points through the available payment methods. Purchased points are credited to the user’s account and remain available until used.
    • Each resource is assigned a point value (for example, 200 points, 400 points, etc.). When You exchange your points for a resource, the corresponding number of points is deducted from Your account.
    • Resource Download Period: After redeeming points for a resource, You have one week to download the resource. If the resource is not downloaded within this period, access to download the resource will expire. In such cases, You may be required to exchange points again to regain access.
  • No Refund on Expiry: Once points are exchanged for a resource, they are non-refundable regardless of whether the resource is downloaded within the allotted time.

4. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You are encouraged to read the terms and conditions and privacy policies of any third-party websites you visit.

5. Termination

We reserve the right to suspend or terminate Your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

6. Limitation of Liability

Notwithstanding any damages You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service or [insert a fixed amount if applicable].

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, data, or other information, business interruption, or personal injury), even if the Company or any supplier has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of implied warranties or limitations on incidental or consequential damages, so some of the above limitations may not apply to You. In such cases, each party’s liability will be limited to the greatest extent permitted by law.

7. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” without any warranty of any kind. To the maximum extent permitted by applicable law, the Company, on its own behalf and on behalf of its Affiliates, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will meet Your requirements, operate without interruption, or be error-free.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Your use of the Service may also be subject to other local, regional, national, or international laws.

9. Dispute Resolution

If You have any concerns or disputes regarding the Service, You agree to first attempt to resolve the dispute informally by contacting the Company. Should a resolution not be reached, any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by the courts of Morocco.

10. Severability and Waiver

10.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, such provision will be modified to reflect the parties’ intention, and the remaining provisions will remain in full force and effect.

10.2 Waiver

The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of future enforcement of that right or provision. A waiver of any term or condition in these Terms shall not be construed as a waiver of any subsequent breach.

11. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Service.
